an open letter to Ebbe Altberg
hi Ebbe.
welcome to our crazy virtual world. i hope it’s treating you well.
i have to say – i am very encouraged by your changes to the lab. the transparency. the return of lindens. and especially your recent words regarding the terms of service.
i understand that crafting a legal document is a difficult business. especially one defining the insanely complex relationship between linden lab and its customers. i don’t envy the task before you – and i encourage you to take your time and get it exactly, precisely right.
in the meantime, i just realized that there’s something you can do immediately to assuage our concerns and help repair our mutual trust. that is: answer a few simple questions about LL’s thinking regarding the TOS. of course, answers here won’t undo the legally binding TOS – but should an ugly dispute arise, i imagine they could be used to shed light on the intent of the TOS.
1) does LL intend for the TOS to allow LL to resell/redistribute derivative works which have been recorded in SL? this would include machinima, musical performances, conferences, and the like.
2) does LL intend for the TOS to allow LL to resell/redistribute content which has never been placed in the SL marketplace? this would include content never intended for wide distribution, private works, images, notecards and the like.
3) does LL intend for the TOS to allow LL to resell/redistribute content which at one time was on the marketplace, but has since been removed by the creator?
my hope is that these will be very easy for you to answer. and if so, i for one will be pleased as punch to return to our shared craziness. (i got an oculus rift for christmas and i’m dying to see SL from the inside.)
